Work dispute – need advice?
I worked in a restaraunt for 2 weeks, I have now left. Basically I was supposed to get paid tips for that 2 weeks on the following Monday after i quit. What happened was that the manager admitted that the tips for everyone were stolen, due to the fact that she took them out of the safe,then forgot to lock them back up and forgot them in a filing cabinet.
Im just wondering if someone can give me some of advice of how to deal with the situation? Do I have a legal right to get that money at some point? Im thinking especially because they got stolen because of her own negligence? Its £200 so i don’t want to just forget about it, UK law only please…thanks in advance

I’d test the story, first and foremost, and ask for the crime reference number for the alleged theft. You don’t need to do that but it’ll help you determine whether her story is false or not.
That aside, if the tips were given to the manager in her capacity as manager and representative of the company, the company now owe you this money under the provisions of ss13-27 of the Employment Rights Act 1996 and their refusal to pay gives rise to an action for unlawful deduction for which an Employment Tribunal will have jurisdiction. For anyone reading this who is tempted to say that the ET only have jurisdiction after a 12 month period, I’ll point out that this is for unfair dismissal claims and that an ET chairman sitting alone is empowered to rule on unlawful deduction claims.
If the manager was acting in a troncmaster capacity, the claim is more difficult but, to be honest, the burden of proving this would be fairly high on the employer since the manager is the most senior person on site. On the basis of the given facts, I’d say that you have a reasonable chance of recovery.
A couple of assumptions have been made in this answer but the main one is that, since you stipulated an exact sum, some formula of calculation had been used to establish an amount due.
