Can I fight ICBC?
I was in a car accident a couple days ago. I am a new driver, so this is raising me to a 55% surcharge-which is costing me $5200 over the next 3 years. I wasn’t the one driving(but I know it’s my car, so I get screwed) and we hit black ice(we had just noticed how bad the roads were and we were slowing down-going 20 km less than posted speed limit at the time) and the car spun out of control until hitting the concrete wall at the side of the highway head on. My 2 questions are:
Is there anything I can do because it was road conditions?(RCMP told us there was another accident 500 meters away). I don’t see why I’m getting screwed when we werent exacly at fault.
My airbags didn`t deploy, is there anything I can do with GM(it`s a 2006 car still with warranty) because the car was not safe and didnt do what it was supposed to(we could have been seriously injured if we were going a little faster.
Any help would be great. This is a huge concern for me.

Despite your low speed it sounds like you were still going too fast for conditions and you hadn’t noticed this in time.
Air bags use multiple sensors and only deploy above a threshold to prevent injury. How much damage was done to your car? about what was done to you?, which doesn’t sound like much. No cause there, even with medical bills
Youthfull operators are rated high, and will get surcharged so high for the exact reason you (friend) lost control of your car,..lack of experience.
About all you can do is shop your insurance for a lower rate, YOu may save a little if you get a car with a smaller engine with good NHTSA crash test rating.
