If I live in Texas a go take a background check at the store and somehow i don’t pass is there any punishment?
I was diagnosed years ago w/ bipolar which I take Rx for. I’m in the market for a new 9mm. I own numerous guns and am probably the safest guy there is with one. If I go fill out the application and and check “no” on all the boxes and just see if I pass the background test, and I fail can I get in any legal trouble or will they just turn me away at the counter?
No you are in correct. I own a 30-30, and my shotguns were all purchased in my name, however i don’t own a pistol and that’s why I ask. Laws for pistols are different, (at least here in Texas)
Just to clear up what the previous poster stated, in Texas you do not have to register or even tell the federal, state or local government you own a firearm.
To answer your question they could get you for perjury. Lying on this form (Form 4473) is a felony and can be punished by up to five years in prison in addition to fines, even if the transaction is simply denied by the NICS (federal form so a federal crime).
I recommend buying from an individual or at a gun show (other than a dealer at a gun show).
The only difference in gun laws in Texas about hand guns and long guns is concealment in public (Sec. 46.02. UNLAWFUL CARRYING WEAPONS). Most of the laws will mention firearms rather than handguns. If you are legal to own a rifle/shotgun then you are legal to own a handgun (Sec. 46.04. UNLAWFUL POSSESSION OF FIREARM).
